General Terms and Conditions for the glucksquelle.com Application (Pre-release Version for Whitelist Registration)

ATTENTION: This document is a pre-release version of the General Terms and Conditions and is subject to further revisions, additions, and modifications without prior notice. Registration for the whitelist does not guarantee access to the game and does not create any legal obligations on the part of the site operator.

1. General Provisions and Acceptance of Terms
   • These General Terms and Conditions ("T&Cs") govern the use of the glucksquelle.com application ("Website"), including all services and content.
   • By registering for the whitelist, the User accepts these T&Cs in full and without reservation.
   • The Operator reserves the right to amend these T&Cs at any time without notice. Continued use implies acceptance.
   • These T&Cs form a legally binding agreement between the User and the Operator.
2. Definitions
   • glucksquelle.com: A simulation game with virtual teams based on real football players' performance.
   • Whitelist: A list of early-registered Users expressing interest in the game.
   • Game: The football product on the Website.
   • Team: A virtual team created by the User.
   • Points: Virtual scores based on players' real match performance.
   • Leagues: Competitive groups of Users.
   • User Content: Any content (text, images, etc.) posted by Users.
3. Registration and Conditions for Whitelist Participation
   • Users must register truthfully to join the whitelist.
   • Users are responsible for protecting their login credentials.
   • The Operator may refuse whitelist inclusion without explanation.
   • Whitelist participation is free and does not guarantee Game access or benefits.
   • Users must meet minimum age requirements under German law (generally 18 years old or with guardian consent for minors).
4. Rules for Using the Website and the Game (Preliminary)
   • Users agree to use the Website and Game legally and in accordance with these T&Cs.
   • Users may not:
     • Interfere with the Website or Game operation.
     • Distribute illegal, abusive, or harmful content.
     • Access other Users’ accounts or system resources unlawfully.
     • Use bots/scripts without written consent.
     • Violate intellectual property rights.
     • Conduct commercial activities without approval.
     • Violate the German Act Against Unfair Competition (UWG).
   • Detailed game mechanics (teams, scoring, leagues) will be published after launch.
   • The Operator may amend game rules (scoring, transfers, leagues, etc.) at any time.
5. Intellectual Property
   • All rights to the Website, Game, and content belong to the Operator or licensors.
   • Use is permitted for personal, non-commercial purposes only.
6. Disclaimer of Warranties and Limitation of Liability
   • The Website and Game are provided “as is” and “as available” with no guarantees.
   • The Operator is not liable for direct/indirect damages, except in cases of intent, gross negligence, or injury to life/body/health under German law.
   • No liability for third-party actions or User content.
   • The Operator does not guarantee accuracy of statistical or match data.
7. Data Protection
   • Personal data is handled per the Privacy Policy, GDPR, and BDSG regulations.
8. Termination and Account Suspension
   • The Operator may suspend or terminate accounts without notice if T&Cs are violated.
   • Users may stop using the Website/Game at any time.
9. Applicable Law and Jurisdiction
   • German law applies (excluding CISG).
   • Disputes are handled at the Operator’s local jurisdiction unless statutory law dictates otherwise (e.g., for consumers).
10. Changes to the T&Cs
    • The Operator may update these T&Cs anytime without notice.
    • Users should check regularly; continued use implies agreement.
